Fortunas Resort (Fortunas Haven Limited) Terms and Conditions:

Welcome to Fortunas Resort,

Alpine haven in the heart of Mount Kenya.

Fortunas; a premium getaway located in the serene environment of Meru, Kenya.
By accessing and using our services, you agree to comply with the following Terms and Conditions:

Please read them carefully as they outline the rules governing your stay and use of our facilities.

1. Reservations and Payment
1.1 Booking Confirmation:

Reservations are confirmed upon receipt of a deposit or full payment as specified at the time of booking.

1.2 Payment Methods:

Payments can be made via credit card, mobile payment (M-Pesa), Till Number, bank transfer, or cash.

1.3 Cancellation Policy:

The customer may cancel a booking at any time before the start of their stay.

Withdrawal must be declared to the Fortunas Resort or authorized agent.

If the stay was booked through a travel agency/ partner, the cancellation should be declared to the agency concerned.

In the interest of the customer, the cancellation should be declared on a durable medium for evidentiary purposes (by writing).

If the customer cancels before the start of the stay or does not check-in,

Fortunas Resort shall not lose its claim to the accommodation price. Instead, insofar as it is not responsible for the cancellation, Fortunas Resort may demand reasonable compensation, for the accommodation arrangements made up to the cancellation and its expenses, depending on the respective accommodation price.

When calculating the legally permissible flat-rate compensation, Fortunas Resort has taken into account the expenses usually saved and other possible uses of the accommodation services. 

The compensation is differentiated according to the time of receipt of the customer’s declaration of cancellation in relation to the start of the stay and according to the type of stay booked and calculated as a lump sum as follows:

59 to 30 days before arrival 30% 

29 to 22 days before arrival 40% 

21 to 15 days before arrival 60% 

14 to 2 days before arrival 80% 

Up to 1 day before arrival and no-show 100%

Stays of more than 15 nights

Up to 90 days before arrival 20% 

89 to 30 days before arrival 30% 

29 to 22 days before arrival 40% 

21 to 15 days before arrival 60% 

14 to 2 days before arrival 80% 

Up to 1 day before arrival and no-show 100%

FORTUNAS SPECIAL RATES

For any stay

Up to 60 days before arrival 30% 

59 to 30 days before arrival 35% 

29 to 22 days before arrival 50% 

21 to 15 days before arrival 70% 

14 to 2 days before arrival 90%

Up to 1 day before arrival and no-show 100%

1.4 No-Show Policy:
Failure to show up on the scheduled arrival date will be treated as a last-minute cancellation, and no refund will be issued.

2. Check-in and Check-out
2.1 Check-in Time:
From 3:00 PM.
Early check-in is subject to availability and may incur additional charges.

2.2 Check-out Time:
By 10:00 AM.
Late check-out requests will be subject to availability and may incur additional charges.

2.3 Identification:
Guests are required to provide valid identification upon check-in (National ID, Passport, or Driver’s License).

3. Occupancy and Room Use
3.1 Room Occupancy:
Each room accommodates a maximum of 2 guests. Extra guests may incur additional charges or require a room upgrade, subject to availability.

3.2 Room Damage:
Guests are responsible for any damage to resort property caused during their stay.
Costs of repairs or replacements will be charged to the guest.

3.3 No Smoking Policy:
Smoking is strictly prohibited inside all rooms and enclosed areas.

Smoking is allowed in designated outdoor areas. Violation of this policy will result in a cleaning fee of 50% of the current room cost.

4. Use of Facilities
4.1 Swimming Pool:(coming soon)
Use of the swimming pool is at your own risk.
Guests are required to follow pool rules and regulations. Children under 12 must be supervised at all times.

4.2 Gym and Spa Facilities: (coming soon)
Guests using the gym or spa must adhere to the resort’s safety protocols.
Usage is limited to registered guests.

4.3 Parking:
Complimentary parking is provided for guests. Fortunas Resort is not liable for loss or damage to vehicles parked on the premises.

5. Pets Policy
5.1 Pets are not allowed on the premises unless expressly approved in advance by management.

6. Events and Functions
6.1 Event Bookings:

Private events such as weddings, conferences, or parties must be booked in advance.
Additional terms and fees may apply.

6.2 Noise Policy:
To maintain a peaceful environment, loud music or disruptive behavior is not allowed past 10:00 PM.

7. Liability
7.1 Guest Responsibility:
Guests are responsible for their personal belongings.

Fortunas Resort is not liable for any loss, theft, or damage to personal property.

7.2 Health and Safety:
Guests must adhere to all health and safety guidelines provided by the resort.
In case of injury or illness, guests should notify the management immediately.

8. Force Majeure
Fortunas Resort is not responsible for any cancellation or interruption of service due to circumstances beyond its control, including but not limited to natural disasters, political instability, or strikes.

9. Governing Law
These Terms and Conditions are governed by the laws of Kenya.
Any disputes arising out of or in connection with the resort’s services shall be subject to the exclusive jurisdiction of the courts of Kenya.

10. Amendments
Fortunas Resort reserves the right to modify or amend these Terms and Conditions at any time without prior notice.
The updated Terms and Conditions will be made available on our website and at the resort.

By confirming your reservation and staying at Fortunas Resort, you acknowledge that you have read, understood, and agree to abide by these Terms and Conditions.
